Welcome to bidToGig.com ("bidToGig," "we," "our," or "us"). By accessing or using our online platform (the 'Platform') to connect with others for services ('Gigs'), you agree to these Terms of Services ("Terms"). If you do not agree, you must not use the Platform.
The Platform includes our website, any mobile or web applications, AI-assisted tools, messaging features, payment features, and related services we make available now or in the future.
Your use of the Platform is also subject to our Privacy Policy,which explains how we collect, use, and protect your information.
1. Scope of bidToGig Services
What bidToGig is
- bidToGig is an AI-powered platform that allows individuals and businesses ('Gig Posters') to post Gigs and independent contractors or service providers ('Giggers') to offer and perform services.
- The Platform focuses on practical services such as moving help, heavy lifting, assembly, and related home or business tasks, and may expand to other categories over time.
- We also provide AI-assisted tools (for example, to help draft gig descriptions, estimate timelines, or suggest services), but these tools are optional and informational only.
How Gigs are formed
- Gig Posters may post, update, or withdraw a Gig any time before accepting an Offer.
- Giggers may respond with Offers that describe how they will complete the work and on what terms.
- When a Gig Poster accepts an Offer, a separate legal agreement ('Gig Contract') is formed directly between the Gig Poster and the Gigger. bidToGig is not a party to the Gig Contract.
- Unless otherwise stated, the Gig Contract covers the scope of work, timing, price, and any special conditions agreed between the parties.
AI tools and automated features
- Certain parts of the Platform may suggest text, prices, time estimates, or other information using AI models.
- AI outputs may be incomplete, inaccurate, or inappropriate for your specific situation; you should always review and edit them before use.
- AI tools do not provide legal, financial, safety, or professional advice. You are responsible for all decisions and content you publish or act on, even if AI tools assisted you.
2. bidToGig's Role and Obligations
Platform only
- bidToGig operates a technology Platform that connects Gig Posters and Giggers and facilitates communication, booking, and payments.
- We do not perform Gigs, supervise work, or guarantee outcomes.
- We are not a party to any Gig Contract between users and are not responsible for the acts or omissions of Gig Posters or Giggers.
No employment relationship
- Giggers are independent contractors, not employees, agents, partners, or representatives of bidToGig.
- Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between bidToGig and any user.
- Giggers are solely responsible for their taxes, insurance, licences, and compliance with applicable laws.
Platform changes and availability
- We may modify, suspend, or discontinue any part of the Platform (including AI features, categories, or pricing) at any time, with or without notice, where permitted by law.
- We try to keep the Platform reliable, but we do not guarantee that it will be uninterrupted, secure, or error-free.
User safety and trust
- We may offer optional tools such as identity checks, document uploads, or ratings and reviews to help users make more informed decisions.
- Any checks we perform are limited in scope and time and do not guarantee a user’s background, qualifications, or suitability. You remain responsible for your own due diligence and safety decisions.
- We may monitor certain activity or content to enforce these Terms, reduce fraud, or comply with legal obligations, but we are not obligated to monitor all activity.
3. User Obligations
You agree to:
- Comply with these Terms and applicable laws.
- Post accurate, truthful information.
- Maintain control of your account and protect credentials.
You must not:
- Use the Platform for illegal or immoral purposes.
- Post false, misleading, or harmful information.
- Upload content or instructions to AI tools that are illegal, harmful, or violate the rights of others.
Eligibility
- You must be at least 18 years old and capable of entering into a binding contract to use the Platform.
- By using the Platform, you confirm that any information you provide is truthful and that you meet these eligibility requirements.
Account and security
- Maintain accurate contact and profile information and update it as needed.
- Keep your login credentials secure and do not share your account with others.
- You are responsible for all activity that happens under your account, including any Gigs or Offers submitted using AI tools.
No circumvention of the Platform
- You must not solicit or accept payment outside the Platform for Gigs that were initiated on bidToGig, or for substantially similar work with the same parties intended to avoid fees.
- If we reasonably believe you are bypassing the Platform, we may reduce visibility, suspend, or terminate your account and pursue any amounts owed.
4. Fees and Payments
Pricing and subscriptions
- Posting a Gig includes a nominal AI scoping service fee (< CAD $3) charged to the Poster to cover real-time AI parameter extraction and computing costs. The total Poster payment is the agreed task price plus this nominal service fee.
- Giggers may need an active subscription or plan to place Offers and complete Gigs. Subscription terms (trial periods, billing cycles, and prices) are displayed at checkout or in your account..
- We may offer different plans (for example, monthly or yearly) and may change plan features or prices from time to time, in line with applicable law and with reasonable notice where required.
Platform service fees
- We may charge service fees to Gig Posters and/or Giggers for using the Platform, such as subscription fees, per‑Gig fees, or success‑based fees when a Gig is successfully completed.
- Fees and any applicable taxes are disclosed before you confirm a payment.
- We may run discounts or promotions that apply different fees for specific users, categories, or regions.
Payment processing
- Payments for Gigs are processed through third‑party payment processors (for example, Stripe) or other payment partners.
- By submitting payment details, you authorize bidToGig and its payment partners to charge the amounts shown at checkout, including applicable taxes and fees.
- For many Gigs, bidToGig (or its payment partner) holds funds in a secure account until the Gig is marked complete, then releases funds to the Gigger minus applicable fees.
Payouts to Giggers
- Giggers become eligible for payout after the Gig Poster confirms completion or after a reasonable period if no dispute is raised.
- We may delay or withhold payouts if we need to investigate potential fraud, chargebacks, policy violations, or legal obligations.
- If a payout is reversed due to chargebacks, refunds, or fraud, you may be responsible for any resulting negative balance.
Taxes
- Gig Posters are responsible for any applicable sales taxes on their purchases, such as GST, HST, PST, or QST, which may be calculated and shown at checkout.
- Giggers are responsible for reporting and paying their own income taxes and any other required remittances.
- We may collect and remit certain taxes where required by law, without creating an employment or agency relationship.
5. Cancellations and Refunds
Before work begins
- If a Gig is cancelled before any meaningful work has started, we may refund the Gig Poster’s payment minus any non‑recoverable processing costs or fees, typically as Platform credits or back to the original payment method, as allowed.
Cancellations by Gig Poster
- If a Gig Poster cancels close to the scheduled time, we may:
- Charge a cancellation fee,
- Reduce or cancel any payout to the Gigger, or,
- Apply other reasonable measures to offset costs and protect Giggers’ time.
- Specific cancellation windows and fees will be described in the booking flow or help centre and may vary by category or region.
Cancellations by Gigger
- If a Gigger cancels or fails to appear, the Gig Poster is generally entitled to a refund of the paid amount.
- Repeated cancellations or no‑shows by a Gigger may result in reduced visibility, suspension, or termination of their account.
Discretionary refunds
- We may, at our discretion, issue partial or full refunds to maintain Platform integrity, handle disputes, or manage fraud.
- Any refund we provide does not mean we accept liability for the Gig or outcomes beyond what is required by law.
6. Privacy Policy
Your use of AI tools on the Platform is also subject to the Privacy Policy. Some inputs and outputs may be stored and used to improve our models, prevent abuse, or comply with legal obligations, as described in that policy.
7. Limitation of Liability
- The Platform and all services, including AI tools, are provided on an "as is" and "as available" basis, without any warranties or conditions, express or implied, to the fullest extent permitted by law.
- To the extent permitted by law, bidToGig is not responsible for:
- The acts or omissions of any Gig Poster, Gigger, or other user.
- The quality, safety, legality, or suitability of any Gig.
- Errors or omissions in AI outputs, suggestions, or automated decisions.
- Delays, failures, or issues caused by third‑party services such as payment processors, hosting providers, or telecommunications networks
- To the extent permitted by law, our total liability to you for any claims arising out of or relating to the Platform or these Terms is limited to the greater of:
- The total fees you paid to bidToGig in the 12 months before the claim, or
- CAD 50.
8. Dispute Resolution
Between users
- Gig Posters and Giggers should first try to resolve disputes directly through the Platform’s messaging and tools.
- We may offer tools such as chat logs, photos, and status updates to help resolve issues, but we are not obligated to mediate every dispute.
Our involvement
- We may review disputes, request information, and make good‑faith decisions about refunds, payouts, or account actions.
- Our decisions are made to protect the Platform and all users and may not fully satisfy every party.
Legal options
- Nothing in this section prevents you from exercising rights available under applicable consumer protection laws or from bringing eligible claims in small claims court where allowed.
9. Termination
- You may close your account at any time through your settings or by contacting us. Termination will not affect rights and obligations that have already accrued (for example, payment obligations or existing Gig Contracts).
- We may suspend or terminate your access to the Platform if we reasonably believe you have:
- Violated these Terms or other policies,
- Engaged in fraud, abuse, or harmful conduct,
- Created legal risk for us or other users.
- If your account is terminated, we may:
- Cancel open Gigs and issue refunds or payouts at our discretion,
- Retain certain information as required by law or legitimate business needs.
10. Governing Law and Changes to Terms
These Terms are governed by the federal laws of Canada and the laws of the province or territory where you reside, unless another law is required by mandatory local rules.
We may update these Terms from time to time. When we make material changes, we will post the updated Terms and update the “Effective Date” at the top. Your continued use of the Platform after changes take effect means you accept the updated Terms.
Appendix A: Model Gig Contract
- Commencement and Term: The Gig Contract begins when the Gig Poster accepts an Offer and continues until terminated as per the agreement.
- Obligations: The Gigger must perform the Gig in a professional and timely manner as agreed.
- Payment: The Gig Poster pays the Agreed Price upon acceptance of the Offer.
- Cancellations: Any cancellations must be communicated through the Platform.
- AI Tools: If users choose to use AI tools to draft parts of their Gig Contract or messages, they remain responsible for reviewing and correcting any AI‑generated content before relying on it.
Appendix B: Country-Specific Terms for Canada
- References to currency are in Canadian Dollars (CAD).
- bidToGig complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
- bidToGig disclaims all liability for any direct, indirect, or consequential losses, except where prohibited by law.
- Refunds, where applicable, will be issued in accordance with Canadian consumer protection laws.
- Where applicable, statutory rights under Canadian consumer protection legislation will prevail over any conflicting part of these Terms.
