Terms of Services

Welcome to bidToGig.com ("bidToGig," "we," "our," or "us"). By accessing or using our online platform (the 'Platform') to connect with others for services ('Gigs'), you agree to comply with and be bound by these Terms of Services ("Terms"). If you do not agree, you may not use our Platform.

Your use of the Platform is subject to our Privacy Policy.


1. Scope of bidToGig Services

Basic Principles

  1. BidToGig provides it's contractor platform to enable Gig Posters to publish Gigs and Giggers to make Offers in response to those Gigs.
  2. Gig Posters may revoke or modify a Gig at any time before accepting an Offer.
  3. Once a Gig Poster accepts an Offer, a Gig Contract is created between the Gig Poster and the Gigger. At this point, the Gig Poster must pay the Agreed Price into the Payment Account.
  4. BidToGig acts as an intermediary to facilitate payments and communications but is not a party to the Gig Contract.

Gig Listing

  1. BidToGig may offer features that enable Giggers to publish listings for services they are willing to provide ('Gig Listings').
  2. A Gig Contract is created when a Gig Poster accepts an Offer on a Gig listing.

2. BidToGig' Role and Obligations

  1. BidToGig provides the Platform in consideration of applicable fees.
  2. BidToGig only permits individuals 18 years and older to use the Platform.
  3. BidToGig does not verify qualifications, or suitability of Giggers or Gig Posters. You are responsible for conducting your own due diligence.
  4. BidToGig is not liable for any aspect of the interactions or transactions between users.
  5. BidToGig may modify, suspend, or terminate accounts if we determine that a user's conduct is detrimental to the Platform.

3. User Obligations

You agree to:

  • Comply with these Terms and applicable laws.
  • Post accurate information.
  • Maintain control of your account and not share it with others.

You must not:

  • Use the Platform for illegal or immoral purposes.
  • Post false, misleading, or harmful information.
  • Charge fees outside the Platform.

4. Fees and Payments

  1. Posting a gig is free on bidToGig. Giggers subscribe to access and complete gigs.
  2. Payment must be made through the Platform's Payment Account.
  3. All fees are non-refundable unless otherwise specified in these Terms or required by law.

5. Cancellations and Refunds

  1. If a Gig Contract is canceled before commencement, bidToGig will refund the Agreed Price minus applicable fees as bidToGig Credits.
  2. Cancellation fees may apply depending on the party responsible for the cancellation.

6. Privacy

Your use of the Platform is subject to our Privacy Policy.

7. Limitation of Liability

  1. BidToGig provides the Platform "as is" and disclaims all warranties to the extent permitted by law.
  2. BidToGig' liability is limited to the fees paid by the user in the 12 months preceding the claim or CAD $50, whichever is greater.

8. Dispute Resolution

  1. Users are encouraged to resolve disputes directly.
  2. BidToGig may, at its discretion, assist in dispute resolution but is not obligated to do so.

9. Termination

  1. Either party may terminate their account at any time. Termination does not affect existing Gig Contracts.
  2. BidToGig reserves the right to terminate accounts for breach of these Terms.

10. Governing Law

These Terms are governed by the laws of Canada. Disputes will be resolved in the respective courts of Province/Territory.

Appendix A: Model Gig Contract

  1. Commencement and Term: The Gig Contract begins when the Gig Poster accepts an Offer and continues until terminated as per the agreement.
  2. Obligations: The Gigger must perform the Gig in a professional and timely manner as agreed.
  3. Payment: The Gig Poster pays the Agreed Price upon acceptance of the Offer.
  4. Cancellations: Any cancellations must be communicated through the Platform.

Appendix B: Country-Specific Terms for Canada

  1. References to currency are in Canadian Dollars (CAD).
  2. BidToGig complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).
  3. BidToGig disclaims all liability for any direct, indirect, or consequential losses, except where prohibited by law.
  4. Refunds, where applicable, will be issued in accordance with Canadian consumer protection laws.

BidToGig Glossary

  • Agreed Price: The agreed amount for a Gig, paid by the Gig Poster into the Payment Account.
  • Cancellation Fee: The fee payable by the Gig Poster or Gigger to bidToGig for cancelling a Gig.
  • Gigger: A user who provides services (Gigs) to Gig Posters.
  • Gig: A service offered or requested on the bidToGig contractor platform.
  • Gig Contract: The agreement formed between a Gig Poster and a Gigger when an Offer is accepted.
  • Gig Listing: A listing by a Gigger detailing services they are willing to provide.
  • Gig Poster: A user who posts Gigs seeking services from Giggers.
  • Offer: A proposal made by a Gigger in response to a posted Gig or Gig Listing.
  • Payment Account: The account used to manage payments between Gig Posters and Giggers.
  • BidToGig Credits: Non-refundable credits issued by bidToGig for cancellations or refunds, usable for future Gigs on the Platform.
